(male announcer) this is the bay area news station, kron 4 news starts now. next at 5. a developing story out of the south bay.where a daycare teacher is accused of drugging children. we'll hear from parents.and what police plan to do. also - another teacher is facing charges that she tied up a 2-year-old after the what school officials are doing.next. developing now at five -- a day-care teacher is behind bars. accused of drugging children to get them to fall asleep. this is the booking photo of 59-year-old deborah gratz, of hollister. she was known as miss debbie to those at the day care center where she worked. police say it happened at the kiddie academy child care facility on monterey road in morgan hill. gratz was a full time teacher, in charge of a class of ten toddlers between one and two years old. she was fired last friday after someone at the daycare center saw her put something into the drinking cups of some children. police arrested graz monday and charged her with several counts of felony child endangerment. >> they had witnessed one of

deborah gratz' class on friday, when the alleged drugging took place, he has been in her care on many other days. some parents expressed confidence in the kiddie academy, which issued a statement vowing cooperation with police, but others say this is news no parent wants to hear. bianca flores has puld caleb out of school for now, saying he won't return until he's been checked out by a doctor. >> as a parent i am concerned. everybody will be handled by the administration and law- enforcement. >> that sounds scary. i would not want that to happen to randy ticket. this child will not be returned until he did his return to -- checked out by a doctor.

estacio reports, van is fighting back - filing a lawsuit against the oakland police department. >> reporter: it was here in at the headquarters of the oakland police department where chou van turned himself in. he says he came down here to clear up his name, that he was not a criminal. but instead he says, officers slapped cuffs on him and threw him into jail. van says he spent three days here at the santa rita jail, until he was released. that was a year ago, and ever since, van says his life has been turned upside down. on tuesday at a news conference van flanked by his attorneys announced a lawsuit against the city and the police department. >> this says it changed my life. all of a sudden i was on television, the internet and a was scared and nervous for my life. that the police would come out

>> a developing story tonight-- the first day of voting at the vatican's papal conclave ended with black smoke billowing from the sistine chapel-- meaning there is still no decision on the next roman catholic spiritual leader. this chimney is the only glimpse the outside world has into what is happening inside the sistine chapel, where catholic cardinals from around the world have gathered to elect a new pope. after the first ballot -- black smoke, signifying no one has yet been chosen. the 115 cardinal electors celebrated a morning mass at st-peter's basilica. they chanted prayers as they processed into the sistine chapel. one-by-one they touched the gospel and swore an oath of secrecy.

church rules prevent cardinals over the age of 80 from participating in the conclave but allow them to attend the meetings that precede the vote. when the next leader of the roman catholic church is chosen, white smoke will rise from the historic chapel. >> catherine: the man accused in the colorado movie theater massacre is now set to go on trial august fifth. this is james holmes in court today. at his arraignment today - his attorneys said they weren't ready to enter a plea. so -- the judge entered a standard plea of not guilty on holmes' behalf. he's accused of killing 12 people and wounding 58 others. in an aurora theater last year. this is video of him from last year -- with no beard prosecutors say they'll announce whether they plan to seek the death penalty at an april 1st hearing. >> catherine: a new york jury has reached a verdict in the so-called cannibal

cop case. they found former police officer gilberto valle guilty of plotting to kidnap and eat women. he was also convicted of hacking a federal law enforcement database. valle was arrested and suspended without pay last october. he did not attack any of the women he plotted against. he's now facing life in prison. the right conditions to sustain life may have once existed on mars. the rover curiosity discovered key ingredients for life during an analysis of rock samples. scientists say there are a range of chemicals -- including sulfur. hydrogen. and oxygen. that suggests living microbes might have been on mars. nasa plans to drill for more samples. >> what a gorgeous day. san francisco, crystal clear skies. berkeley you can see
